A recent analysis by The Doctors Company, examining 490 closed malpractice claims between 2010 and 2024, highlights the most common contributing factors behind ophthalmology-related lawsuits. 

According to the report, here are the eight top contributing factors for ophthalmology malpractice reports:

  • Technical performance: 60%
  • Patient factors: 39%
  • Communication between patient/family and providers:28%
  • Patient assessment issues: 18%
  • Selection and management of therapy: 17%
  • Insufficient or lack of documentation: 15%
  • Communication among providers: 8%
  • Failure or delay in obtaining consult or referral: 8%
