Motion to Block CRNA Provision of Anesthesia Without Physician Supervision in California Denied by Court

The San Francisco Superior Court has denied a motion aimed at requiring Calif. Gov. Arnold Schwarzenegger to withdraw his letter to CMS which opted the state out of the federal Medicare rule requiring physician supervision for CRNAs to administer anesthesia, according to the California Society of Anesthesiologists.

The motion was filed by CSA and the California Medical Association in February.

In light of this ruling, CSA and CMA are considering other actions including appealing the ruling, according to the CSA.

California is one of 16 states to have opted out of the rule and allow CRNAs to administer anesthesia without physician supervision. Colorado became the 16th state to opt out of the federal Medicare rule in September.
