In September 2018, a complaint alleged that Rajendra Bhayani, MD, denied a patient access to her medical records after she requested them, the report said. Dr. Bhayani was provided technical assistance regarding compliance, and the case was closed.
The patient filed a second complaint, saying she still didn’t get access to her records, the report said. The case was reopened, and the Office for Civil Rights found Dr. Bhayani’s failure to provide the records was a “potential violation of the HIPAA right of access standard.”
The patient received her medical record in September 2020, the report said. Along with the payment, the settlement includes a corrective action plan and two years of monitoring by the OCR.
