4 current trends in colonoscopy litigation

Millions of colonoscopies are performed in the United States every year, and while risks associated with the procedure are typically low, there are complications, such as colon perforations, that could lead to litigation, according to a MD News report.

Juries tend to sympathize with patients who have undergone colonoscopy complications. Current trends in colonoscopy litigation include the plaintiff’s attorney questioning:

•    Whether the diagnosis should have been made before the patient left the colonoscopy facility
•    The adequacy of the discharge instructions
•    The communications between clinician and patient following discharge
•    The response time once the patient’s symptoms suggested more than routine post-procedural symptoms

However, according to the report, clinical documentation is essential for physicians. Not only does it help physicians defend lawsuits but also deters patients from filing lawsuits, according to the report.
