A $25.6 million malpractice lawsuit against orthopedic surgeon Richard Edelson, MD, is now underway, NBC affiliate KGW8 reported March 11. The lawsuit was filed by former Portland (Ore.) Timbers goalkeeper Jake Gleeson, who alleged that a 2018 surgery ended his professional soccer career.
According to the lawsuit, Mr. Gleeson developed shin pain in the summer of 2018 and was diagnosed with stress fractures in both shins. He was then advised to undergo surgery to have metal plates attached to his shinbones.
The lawsuit alleges that Dr. Edelson, one of the team’s physicians, failed to properly sterilize an orthopedic plate used in the procedure. It further claims that, during surgery, Dr. Edelson realized a plate was missing and brought one in from an outside facility. The plate was then subjected to a rapid “flash” sterilization before being implanted.
Following the procedure, Mr. Gleeson’s right tibia became infected, requiring an additional surgery. However, the lawsuit claims that the plate allegedly responsible for the infection was not removed. Over time, infections developed in both legs, ultimately leading to 14 additional surgeries.
As a result, Mr. Gleeson, now retired, says he can no longer run or jump without debilitating pain. He is seeking $600,000 for medical expenses, $5 million in lost wages and $20 million for pain and suffering.
Mr. Gleeson has already reached a settlement with two other defendants, including an ASC in which Dr. Edelson has partial ownership.
