U.S. Attorney’s Office in Colorado Launches Investigation on DaVita

The U.S. Attorney’s Office for the District of Colorado has opened a grand jury investigation into DaVita, a Denver-based kidney-dialysis firm, according to a Denver Post report.

Kent Thiry, CEO of DaVita, said the investigation is in its preliminary stages. He also said this investigation overlaps with a 2005 investigation by the U.S. Attorney’s Office in Missouri looking into allegations that DaVita overused Epogen and billed the government for it. Mr. Thiry said prosecutors in Colorado are particularly interested in the firm’s relationships with physicians.

“We do thousands of transactions, including hundreds with physicians, and we work hard to get every one right,” Thiry said in the report. “We are comfortable and confident in our business practices.”

A spokesperson for the U.S. Attorney’s Office in Colorado declined to comment on the investigation, according to the report.
