Florida Clinic Owner, Brother Plead Guilty to Medicare Fraud

A Miami infusion clinic owner and his brother pleaded guilty to their involvement in a Medicare fraud scheme, according to a news release by the Department of Justice.

Rolando Nogueira owned and operated T&R Rehabilitation Professional Corp., a clinic that purported to provide injection and infusion treatments to HIV patients. His brother, Jose Nogueira, worked at the clinic. Mr. Rolando Nogueira admitted to conspiring with others to enlist patient recruiters and patients. Mr. Jose Nogueira admitted he and his associated paid kickbacks and bribes and billed Medicare for HIV infusion services that were not medically necessary or ever provided.

From Jan. 2003 to July 2005, T&R submitted approximately $13.7 million in fraudulent claim to Medicare. Medicare paid approximately $4.41 million of those claims.

Co-defendants Modesto and Victoria de la Vega pleaded guilty and are awaiting sentencing.
