Dr. O’Donnell owns the building containing Kirkwood Surgery Center and alleges in court documents that KSC signed a five-year lease in April 2006, agreeing to pay an annual rent of $216,880.
He also alleges that KSC vacated the premises in Aug. 2010 without notice and stopped paying monthly rate payments in Sept. 2010.
Dr. O’Donnell alleges he has incurred costs for the replacement and repair of A/C units and irrigation systems which were damaged during the surgery center’s tenancy. According to the lease agreement, the surgery center was responsible for maintaining and repairing these systems.
Dr. O’Donnell is seeking a judgment in excess of $300,000.
