Novant Health in Winston-Salem, N.C., challenged the surgery center project in 2010, which regulators approved for a certificate of need. Now, the North Carolina Supreme Court “declined to consider the latest appeal” from Novant against the N.C. Division of Health Service Regulation.

The 72,300-square-foot surgery center would include eight operating rooms and two procedure rooms, according to the report.
