False Claims Act Healthcare Provider Scrutiny, Settlements Increased in 2012

Healthcare providers came under increased False Claims Act scrutiny in 2012, but also achieved many successful court decisions, according to Mondaq.

In the past year, the Department of Justice won $3 billion in healthcare-related FCA judgments and settlements. Healthcare-related collections accounted for 60 percent of all industry FCA collections, according to the report.

However, of the FCA cases that made it to trial or appellate levels, more healthcare providers won favorable judgments.

Providers should expect to face steep challenges in 2013, as the DOJ will bring an increased number of FCA claims into question. But members of the judicial system may become skeptical of the most aggressive healthcare-focused prosecutions, according to the report.
