Anthem considers Supreme Court review of Cigna deal

The Anthem-Cigna merger saga may not be over as Forbes reports Anthem is considering further legal action to keep the deal on the table.

Here's what you should know.

1. In a statement on April 28, Anthem said, "We're committed to completing the transaction and are currently reviewing the opinion and will carefully evaluate our options."

2. Forbes reports Anthem has expressed interested in the case's lone dissenting judge Brett Kavanaugh's opinion. Mr. Kavanaugh was the only dissenting opinion in the three-person panel. He wrote the deal would benefit consumers.

3. Forbes reports Anthem could either ask the appeals court for another review or seek an audience with the U.S. Supreme Court. Some analysts believe the Supreme Court could be "potentially more friendly" to Anthem because of its conservative leaning, but a majority of analysts believe the deal is dead.

4. Former Federal Trade Commission Policy Director David Balto told Forbes, "The odds of Anthem securing Supreme Court review is like landing a hole in one on Mars."

5. The insurers still have civil allegations filed against each other. Anthem accused Cigna executives of sabotage, and Cigna is seeking a $1.8 billion breakup fee.
