What you should know:
1. A coworker accused Mr. Guty of sexually assaulting a woman under general anesthesia in January 2015.
2. Park County District Judge Bill Simpson dismissed the case against Mr. Guty with prejudice, after a filing from Mr. Guty’s attorney claimed that the defendant’s alleged actions were “substantially and materially inconsistent with the information that was provided to law enforcement and what the state relied on in filing this matter.”
3. The accuser allegedly made a “substantive change” in her statements between the initial investigation in 2015 and a second investigation in 2018.
Mr. Guty’s attorney wrote, “The state no longer has a prosecutable case based upon these inconsistent statements. This dismissal in no way involves the credibility of the confidential victim in this matter.”
4. The surgery center fired Mr. Guty, and he let his nursing license expire at the end of 2018. He is currently not a registered nurse in Wyoming.
5. He entered into a plea deal in November 2017, but appealed to the state supreme court. The court sent his case back to Park County, where it was dismissed.
