Proposed New Jersey Bill Would Criminalize the Waiver of Co-Payments and Deductibles

A bill introduced by New Jersey State Senator Nia Gill would criminalize the waiver of co-payments and deductibles by healthcare providers in the state.

The bill, S-1743, would prohibit out-of-network facilities in the state from waiving these costs for patients or face criminal penalties.

Representatives from the ASC industry recently met with Sen. Gill, who plans to introduce the bill at the next meeting of the Senate Commerce Committee, scheduled for May 27, according to Mark Manigan, JD, an attorney with the Health Law Practice Group at Brach Eichler in Roseland, N.J.

The current version of the bill will be amended to include a “financial hardship” clause, but no specifics of the clause’s language have been released, according to Jeffrey Shanton, director of business management at Journal Square Surgical Center in Jersey City, N.J, who attended the meeting with Rep. Gill last week.
