Surgery Center CON Denial Appealed in North Carolina

FirstHealth of the Carolinas and the Surgery Center of Pinehurst (N.C.) have appealed a state denial of a certificate of need for a new freestanding ASC in Hoke County, N.C., according to a news release from FirstHealth.

FirstHealth, a nonprofit hospital system in Pinehurst, N.C., and the Surgery Center of Pinehurst, a for-profit multi-specialty ASC jointly owned by FirstHealth, area physicians and Nueterra Healthcare, submitted the application in Aug. 2009 to build the new ASC.

The state questioned the need for the new ASC given that CONs had recently been approved for two hospitals in the same area, each of which includes operating rooms, according to the release. In addition to operating rooms, however, the proposed Surgery Center of Hoke would also include pain procedure rooms.

The partners plan to refile a CON application for the ASC in 2010.
