N.J. Insurers Offer Unjustified Criticism at Law Allowing Physicians to Refer Patients to Their ASCs

The Property Casualty Insurers Association of America (PCI) have issued a statement unwarrantedly criticizing a recently passed bill by the New Jersey Senate that allows physicians to refer patients to ASCs in which they have a financial interest.

While the legislation (S787) is likely to expand access to quality care for patients by lifting restrictive provisions on physicians, PCI is claiming the new law will "jeopardize patients’ best interests" and the legislation "threatens the fight against insurance fraud and will drive up auto insurance costs."

The bill, with Sen. Richard Codey and Sen. John Adler as the primary sponsors, passed by a vote of 37-1, with two senators not voting. It also requires single operating-room facilities to register with DHSS.
