New York Surgery Centers Face Possible 10% Surgical Procedures Tax

New York Gov. David Paterson is proposing a 9.63 percent tax on surgical and radiologic procedures performed in private ASCs, physicians’ offices and urgent care settings as part of his 2009-10 executive budget, according to a message the New York American Academy of Otolaryngology-Head and Neck Surgery (AAO-HNS) sent to its members.

This proposed tax would require insurance companies to pay the Department of Health a percentage surcharge on all payments made for services provided by physicians in private offices or urgent care facilities which are billed as surgery or radiology services.

The tax would likely be passed on to patients through higher premiums, co-payments and deductibles, according to the message. It would also likely lead to lower reimbursements for providers. 
 
The AAO-HNS and the New York State Society of Otolaryngology is encouraging its members to contact their state legislators to oppose the proposal, and provided a pre-written letter that can be filled out and e-mailed to legislators.
