New Jersey Legislature Increases Cap on Ambulatory Care Facility Tax

The New Jersey legislature has approved an increase of the cap on ambulatory care facility assessments from $200,000 to $350,000 as part of its state budget.

The change will go into effect on July 1, 2010. Ambulatory facilities in the state currently pay a 2.95 percent gross receipts tax. While the percent of gross receipts taxed will not change, the cap will be increased by 75 percent.

The original version of the budget eliminated the cap, but ASC advocates in the state were able to convince the governor’s office to increase rather than remove the cap, says Mark Manigan, JD, an attorney with the Health Law Practice Group at Brach Eichler in Roseland, N.J.
