The ruling found that Volcano Corporation and its subsidiary, Axsun Technologies, violated a Massachusetts law against engaging in unfair competition and unfair or deceptive acts or practices. The violations arose in connection with Volcano’s acquisition of Axsun technologies, a key supplier for St. Jude’s subsidiary LightLab Imaging. The court found the acquisition to be a means of “impeding the growth of a major competitor.”
The court also found there was a “scheme orchestrated by Volcano and implemented with Axsun’s assistance” to supply LightLab with a less effective laser to adversely affect the marketability of LightLab’s imaging system.
The decision adopts findings from a Feb. 2010 verdict in the same suit, in which a jury found that Axsun breached its contract with LightLab and disclosed LightLab trade secrets to Volcano, among other violations.
