Plans for a new ASC in Alabama have stumbled when an administrative
law judge denied the application for the facility after hearing arguments from
both sides of the project, according to published reports.

The applicant, St. Vincent’s Health System, proposed to
build a new surgery center in the city of Hoover, but faces opposition from Brookwood Medical
Center.

The judge’s order is advisory, with the state’s
Certification of Need (CON) review board hearing the case next, likely this
summer.

In his order, the judge indicated that St.
Vincent failed to provide the necessary facts and projected
patient figures to meet the state’s CON requirements.

Brookwood has proposed its own ASC in the city of Vestavia Hills, with St. Vincent’s opposed to the project. Brookwood’s
proposal is scheduled for a hearing in September.

The news of St. Vincent’s application snag comes just days
after another Alabama ASC, Pleasure
Island Ambulatory
Surgery Center,
saw its plans for development blocked when the Alabama CON Review Board said it
would not reconsider the proposal for the facility, as reported by Becker’s ASC
