Residents Appeal Approval of New Massachusetts Surgery Center in Winchester

Three residents of Winchester, Mass., have asked their Superior Court to annul approval of a new ambulatory surgery center proposed by Winchester Hospital, according to a report from the Daily Times Chronicle.

 

The residents are asking the court to void the Zoning Board of Appeals approval of the hospital's proposed 32,000-square-foot ASC on the basis that, amongst other claims, the Zoning Board of Appeals relied upon inaccurate and incomplete information, ignored some recommendations from the Town Engineer and Planning Board and failed to impose conditions to minimize construction impacts, according to the report. The Zoning Board of Appeals granted approval in the summer.

 

The bases for the residents' request for annulment include concerns about possible injuries relating to construction, traffic congestion, water contamination and electricity shortages.

 

The project also recently received draft approval from the Massachusetts Environmental Policy Act.
