How often do malpractice cases end in favor of the physician? 3 stats to know 

Forty-one percent of physician malpractice cases are dismissed, according to Medscape’s 2023 “Physicians and Malpractice Report,” published Oct. 26.

Medscape surveyed 3,037 physicians across 29 specialties from May 5 to July 5 for the report.  

Here’s how often malpractice cases end in favor of the physician:

Case dismissed: 41%

Case settled: 32%

Case favored physician: 12%
