The Missouri state Court of Appeals for the Eastern District reversed the not guilty summary judgement after determining that the plaintiff’s expert testimony was based on opinion more than fact.

Huilin Li, MD, the attending physician on the shift, testified that staff members were unaware that the patient had a condition.
In between shifts, Dr. Li alleged he was not made aware he was the attending physician on the evening shift.
The plaintiff’s expert witness testified that physicians are required to see patients within an hour of a shift change.
