The surgeons at Great Lakes Surgical Associates have already received a 10-year tax break for the ASC, which would be built by renovating a vacant medical building and turning it into a four-unit surgery center.
Their application would come after Eastern Niagara Hospital, also based in Lockport, N.Y., filed its own certificate-of-need application to develop a more than $5.6 million Lockport surgery center. Eastern Niagara has protested the Great Lakes Surgical Associates plans for its ASC on grounds that it would cost the hospital $1.5 million in annual revenue, according to the report from The Buffalo News.
The Health Department has not provided any indication whether it would approve either CON.
