A legal fight between a New York radiologist and his former practice over a $20 million private equity deal has come to an end, according to court documents.
Gregory Ball, MD, Southtowns Radiology Associates and the other parties in the case agreed to discontinue the action “in its entirety, with prejudice,” according to a stipulation filed Oct. 28 in Erie County Supreme Court. The agreement covers “all claims, cross-claims, and counterclaims” and states that no party owes another costs or attorneys’ fees, “except as otherwise agreed to by the parties.” Buffalo Business First first reported the case’s end Nov. 2.
Dr. Ball sued the Buffalo-area practice in February 2025. He alleged his partners pressured him into signing redemption agreements that bought out his ownership interest for $313,000 before the practice sold its assets to Rezolut for $20 million in 2023. He contended he was owed at least $2 million.
Attorneys for the practice and eight of its physicians argued in an April 2025 motion to dismiss that Dr. Ball had been offered the same terms as his partners: long-term employment and equity with Rezolut.
“Unlike the other partners, Dr. Ball declined that offer,” the filing states.
A judge dismissed 11 of Dr. Ball’s claims in December, and eight of his former colleagues countersued in April, seeking at least $250,000. They alleged his lawsuit had delayed a $2 million holdback payment from Rezolut. Dr. Ball’s attorney told Buffalo Business First at the time that the countersuit was meritless and that he planned to appeal the December ruling.
The October stipulation was signed by attorneys for Dr. Ball, the practice and its eight physicians, two Rezolut entities and law firm Epstein Becker & Green, which was also named as a defendant.
Rezolut has since changed hands. Colorado Springs, Colo.-based Envision Radiology acquired Rezolut and its 42 outpatient imaging centers in a deal finalized Jan. 1. Terms were not disclosed.
