Judge dismisses Catholic Health arguments, orders revote on Kaleida’s ASC project

In April of last year, the Kaleida Health’s ambulatory surgery center in Orchard Park, N.Y., was denied a certificate of need. Now, administrative law judge John Harris Terepka has ruled that Catholic Health System’s arguments against the project were insufficient, according to a Buffalo Business First report.

The state’s Public Health and Health Planning Council will hold a revote on the project April 16.

The Southtowns Ambulatory Surgery Center project would cost $2.7 million. Catholic Health argued another ASC in the area would be damaging to its business. Judge Terepka pointed out the area has a relatively low number of ASCs and one more center would not be nearly as damaging as Catholic Health suggested, according to the report.
