Iowa Supreme Court overturns clinic’s $97M malpractice verdict

The Iowa Supreme Court has overturned a $97 million malpractice verdict, marking the largest award in state history, KCRG reported Nov. 9.

Mercy Iowa City, Jill Goodman, MD, and OB-GYN Associates faced a malpractice lawsuit after a patient’s baby sustained injuries during childbirth, according to the report.

The suit alleged that the baby suffered brain damage due to Dr. Goodman’s negligence while using forceps and a vacuum delivery device.

The baby was diagnosed with an ischemic brain injury, seizures, facial nerve palsy, and a skull fracture with subdural hemorrhage. In March 2022, a jury awarded the family $97.4 million.

The case will now proceed to a new trial, the report said.
