Dr. Moore’s license was suspended in March after patients accused him of inappropriate behavior during pelvic exams, including taking photographs without permission, not wearing gloves and ordering unnecessary medical tests.
The women in the lawsuit range in age from 15 to 73 and saw Dr. Moore throughout the span of nearly three decades.
The lawsuit alleges the three health facilities — Marion, Ind.-based Dr. Moore’s Women’s Healthcare, Indianapolis-based Ambulatory Care Center and Marion (Ind.) General Hospital — failed to supervise and monitor Dr. Moore’s behavior and activities.
The lawsuit claims the facilities “had actual and constructive knowledge and was on notice of the allegations of medical negligence and abuse of female patients and took no effective steps to detect, prevent or report the negligence, misconduct or abuse.”
Indiana’s malpractice laws cap damages at $250,000 in any one case, but each of the 83 women is seeking damages under separate and distinct malpractice cases.
“Dr. Moore was a practicing obstetrician/gynecologist for more than 40 years before retiring at age 76 in December, 2022,” Dr. Moore’s attorney, Ronald Mingus, told WXIN in a statement in January. “His medical license was never subjected to any disciplinary action by any state licensing agency during his long career. He cares about his patients and worked very hard to provide them with excellent care.”
