North Carolina Senate could eliminate CON laws — 4 insights

The North Carolina Senate included several certificate of need-related measures in its proposed 2020 fiscal budget, JD Supra reports.

What you should know:

1. The Senate adopted its budget May 31. It includes several measures that would affect CON laws.

2. However, the North Carolina House has not included any of the language related to CONs in its budget, nor has it passed any laws related to repealing CONs.

3. If Gov. Roy Cooper accepts the CON-related elements, North Carolina would no longer require CON approval for:

  • ASCs
  • Operating rooms
  • Gastrointestinal endoscopy facilities and rooms
  • Diagnostic centers
  • Dialysis facilities
  • Psychiatric facilities
  • Immediate care facilities
  • Chemical dependency treatment facilities
