A trial court previously found that the carrier’s rates were fairly established, and the court’s decision has since been upheld on appeal. The plaintiffs have argued that the rates are based on flawed data.
The ASCA brief focuses on the policy rationale for fair out-of-network payments and provides a perspective on the difference between non-contracted provider payments and those made by government programs and other insurers to contracted providers. The brief seeks to convince the Arizona Supreme Court to review the appellate court decision.
