According to the report, a pediatric patient was admitted to the hospital with a fever in October. Three days later, the child died of an apparent medication overdose, sparking an investigation by New York State Department of Health on behalf of CMS. Failure to remedy deficiencies means Brookdale Hospital could lose its Medicare status.

The hospital faced a similar investigation and threat in July, but officials submitted a corrective action plan that was approved by regulators.
