Malpractice suit against anesthesiologist dismissed unanimously — 4 insights

A New York state appeals court dismissed a malpractice case against an anesthesiologist who was accused of administering a sedative which allegedly contributed to a patient developing a pain syndrome, New York Law Journal reports.

Here's what you should know:

1. The court dismissed the claim on strong defense evidence that juxtaposed "conclusory assertions" from the plaintiff's experts. The defendants included New York Pain Care Center, Manhattan Medical Suite and at least two physicians, all based in New York City.

2. The state court ruled unanimously that the suit should be dismissed.

3. The decision reversed a 2016 decision by the Bronx Supreme Court denying summary judgment to the defendants.

4. Defense attorney Peter Taglia, of Dwyer & Taglia, said to the Law Journal, the panel's decision "was an excellent analysis of a very complicated case, because there were many issues, and the court could have easily said let's just leave it for a jury, or go ahead with a Frye hearing."
