Dallas Anesthesiologist to Receive $10.8 From Former Employer Over Alleged Defamation of Character, Breach of Contract

Neal Fisher, MD, of Dallas will receive $10.8 million from his former employer, Pinnacle Anesthesia, for alleged defamation of character and breach of contract, following a decision by the Supreme Court of Texas not to hear additional appellate arguments, according to a news release from Dr. Fisher’s law firm for the case.

Dr. Fisher was a founding member and shareholder in Dallas-based Pinnacle Anesthesia Consultants, which provides obstetric anesthesiology services to Texas Health Presbyterian Hospital Dallas. He claimed wrongful termination after allegedly questioning company billing practices and raising questions about an increasing volume of patient complaints. According to the news release, Pinnacle Anesthesia accused the physician of abusing alcohol and drugs and asked him to undergo tests conducted by Presbyterian’s Impaired Physician Program, which he passed.

In 2007, a Dallas jury voted 12-0 in Dr. Fisher’s favor, finding Pinnacle liable for defamation of character and breach of contract. A Dallas appeals court upheld the jury’s findings last year, and the Supreme Court of Texas recently denied Pinnacle’s request for an appeal.
