Pennsylvania Bans Mandatory Overtime for Many Healthcare Employees

The Pennsylvania legislature has enacted a new law that says a healthcare facility, including ASCs and hospitals, cannot — in most cases — require an employee involved in clinical care to work in excess of an agreed to, predetermined and regularly scheduled daily work shift.

The bill applies to nurses and other clinical-care employees but does not apply to physicians, physician assistants, dentists and other employees not involved in patient care services such as maintenance and food service staff.

The bill (H.B. 834) says that the refusal of an employee to accept overtime “shall not be grounds for discrimination, dismissal, discharge or any other employment decision adverse to the employee.”

The law does not apply to certain scenarios, including emergency situations, if an employee is needed to complete a procedure already in progress or if an employee voluntarily accepts overtime.
