In fiscal year 2010, the Department of Justice recovered more than $3.1 billion from whistleblower lawsuits and False Claims Act prosecutions. TAF calculated that the FCA recovered more than $15 for every dollar invested in healthcare investigations and prosecutions.
Additionally, TAF reported that of the top 10 FCA settlements that occurred in FY 2010, eight of the settlements involved fraud committed by pharmaceutical companies. The top 10 settlements recovered approximately $2.7 billion. The top FCA settlement was $600 million paid by Allergan, a pharmaceutical company that promoted off-label use of its product Botox, according to the news report.
