Federal Government Releases New Guidelines for Horizontal Mergers

The Federal Trade Commission and the Department of Justice have released revised horizontal merger guidelines — the first time the guidelines have been revised in 18 years, according to a report by the Healthcare Financial Management Association.

The guidelines outline the techniques, practices and enforcement policies the agencies will use to evaluate mergers and acquisitions involving competitors and are intended to help businesses better understand how the FTC and DOJ evaluate proposed mergers.

The latest version of the guidelines include a section of evidence the agencies use to predict the competitive effect of mergers, according to the report.
