Federal Health Insurance Mandate Will Be on Missouri Ballot in August

Missourians will be the first to vote on the new health insurance mandate in a measure to appear on the state’s Aug. 3 primary ballot, according to a report by KMOV TV.

The Missouri House recently approved the ballot entry, which seeks to overturn a key provision of the federal health reform law.

After the Missouri vote, similar measures will appear on Nov. election ballots in Arizona, Florida and Oklahoma. In addition, Arizona, Idaho and Virginia have passed laws barring the mandate, according to the American Legislative Exchange Council.

These state actions would have to pass muster in the courts, which generally have held that federal law trumps state law. Proponents argue that the federal government has overreached its constitutional authority by requiring citizens to purchase a particular product.
