The current law requires ambulatory facilities to discharge or transfer patients after 24 hours. The new legislation is driven by the demand for total joint surgeries and procedures with longer recovery time to be performed in ASCs. Moving these cases into the ASC could provide lower infection rates and cost of care, according to the NHASA report.
