Sentara received approval on the ASC’s site plan in 2002 and received a building permit for the facility in July. However, Chesapeake officials halted construction efforts because Sentara did not also have a conditional use permit, according to the report. The conditional use permit requirement became part of city code in 2007, after Sentara’s site plan was approved.
Sentara appealed the requirement and Chesapeake’s planning commission recently ruled that construction on the ASC could move forward without the condition permit.
