According to the release, Dr. Cleveland certified that certain patients qualified under Medicare for power wheelchairs purchased from Mr. McElveen, owner of durable medical equipment provider Positive Home Oxygen, in exchange for Mr. McElveen referring patients to Dr. Cleveland’s practice.
Mr. McElveen and Dr. Cleveland face maximum sentences of up to 10 years of prison, fines of up to $250,000 and three years of supervised release following any imprisonment. Positive Home Oxygen faces a fine of up to $500,000, according to the release.
