EyePoint Pharmaceuticals has agreed to pay the U.S. government $4,657,463.18 to resolve False Claims Act allegations tied to its ophthalmic drug DEXYCU.
According to a July 17 news release by the Justice Department, the Waltham, Mass.-based company allegedly paid kickbacks to ASCs between Jan. 1, 2019, and March 1, 2023, to induce them to purchase and dispense DEXYCU, an injectable treatment for ocular inflammation following cataract surgery.
The government said EyePoint ran an “Assurance Program” that reimbursed ASCs when insurers denied or underpaid DEXYCU claims, and offered ASCs excessive free samples of the drug.
EyePoint also entered a five-year Corporate Integrity Agreement with HHS’ Office of Inspector General and will pay an additional $21,518.68 to participating states.
