Allstate Sues Former Owner of New Jersey Surgery Center, Seeks $4.8M in Benefits Reimbursement

Allstate Insurance has sued the former owner of Market Street Surgical Center in Saddle Brook, N.J., seeking reimbursement of $4.8 million in benefits, according to a report by The Record.

According to the report, the suit alleges that John C. Quinn’s ownership of the Market Street Surgical Center violated state law. The suit says that Mr. Quinn obtained a state license to operate the surgery center in May 2002. In April 2008, according to the state attorney general, Mr. Quinn plead guilty to billing at least 10 insurance companies for administering to anesthesia to at least 27 patients after his nursing and nurse anesthetist licenses had expired.

In 2004, the state nursing board suspended his license for five years. Allstate’s lawsuit says that under state law, the guilty plea should have prevented Mr. Quinn from owning or operating a surgery center. The company is seeking the reimbursement of benefits paid through auto-insurance policies, in addition to triple damages.

According to the report, Mr. Quinn also served as the former owner of Wyckoff (N.J.) Surgical Center and Pompton Plains (N.J.) Surgical Center.
