The TAA bill would have included a Medicare cut to imaging to offset the cost of the bill. Sen. Mike Crapo filed two ASC-related amendments that would have been added during the markup, including:
1. Section 2 of the Wyden-Crapo bill, which would tie future updates to the HOPD market basket.
2. Section 5 of the Wyden-Crapo bill, which would permit same-day surgery at ambulatory surgery centers.
The “mock” markup was scheduled because Congress cannot offer amendments to final implementing bills submitted by the administration under the Trade Promotion Authority Act procedures. Congress may use mock markups to offer amendments to the proposals, but not the final implementing bill. Amendments adopted during the mock markup are only advisory and not binding.
