Virginia's Lawsuit Against Health Reform's Constitutionality Moves Forward
A U.S. District Judge has denied the Justice Department's attempt to dismiss a lawsuit by the state of Virginia challenging the constitutionality of health insurance coverage mandates that are part of the federal health reform law, according to a report by the Boston Globe.
The judge ruled that further hearings were needed to determine the merits of the case. The suit raises several complex constitutional issues, including whether or not Congress has the right to tax not purchasing a certain good or service under the commerce clause, according to the report.
Hearings on the case are scheduled for October.
