NJAASC Sends Letter of Objection to NJDOBI

The NJAASC recently sent a formal letter of objection to the New Jersey Department of Banking and Insurance, regarding the new Liberty Mutual Assignment of Benefits form that went into effect for motor vehicle claims on February 17.
 
Brach Eichler on behalf of the NJAASC drafted the letter, which raised complaints about the form, specifically the Medical Provider Agreement.
 
"Of utmost concern is the Medical Provider Agreement attached to the Assignment of Benefits form, that Liberty Mutual says must be used for their policyholders," said Jeff Shanton, Chair Advocacy and Legislative Committee of NJAASC.

"I had contacted the Department and raised my concerns with this form, but their reply was that the form was consistent with regulations, specifically N.J.A.C. 11:3-4.9, which permits insurers to assign duties and benefits in accordance with reasonable restrictions.
We do not consider the requirements to be reasonable restrictions, and in our opinion do not reflect N.J.A.C. 11:3-4.9," said Mr. Shanton.

"We further believe that this form is in direct contravention of the limitations regarding assignment of benefits set forth by the New Jersey Supreme Court in Selective Insurance vs. Hudson East Pain."
 
NJAASC is asking that the Department rescind its approval of the Liberty Mutual forms.
