Non-Compete Agreement Imposed by Doctor Group on Physician's Practice Upheld by Court

An employment contract's non-compete clause did not unreasonably restrict a physician's practice, the Kansas Court of Appeals has ruled. The non-competition agreement in the contract between a physician group and a physician placed restrictions on where the physician could practice after employment was terminated.

MarCap Acquisition by Tygris Completed

Tygris Commercial Finance Group, a recently formed commercial finance company, has completed its acquisition of substantially all of the assets and business of MarCap, a Chicago-based middle market healthcare equipment finance company. MarCap joins Tygris Asset Finance, Tygris's middle market equipment leasing and asset finance business led by Laird Boulden, and will continue to operate under the MarCap brand.

Health System Settles Overpayment Claims With Feds for $7.75 Million

Baptist Health South Florida Inc., a healthcare system headquartered in Miami, has agreed to pay the United States $7,775,000 to settle claims that it violated the False Claims Act and the Stark Statute between 2003 and 2005, by paying excessive compensation to an oncology group that was a source of patient referrals to two of Baptists hospitals, the U.S. Department of Justice has announced. The settlement resulted from the company's disclosure to the Department of Health and Human Services Office of Inspector General.

Hospital Did Not Have Duty to Disclose Fired Anesthesiologist's Drug Problem, Says Federal Court

A Louisiana hospital did not have a duty to disclose an anesthesiologist's drug problem in a reference to a prospective hospital employer, and therefore cannot be held liable for patient injuries the impaired physician subsequently caused at the new hospital, a federal appeals court has ruled.
