Further Assistance Interpreting the "One-Third" Rule

Q: Our general surgery group is an initial investor in an organization currently operating as a hospital-owned multi-specialty ASC, but that will convert to a joint-venture-owned ASC in a few months. It currently performs very little volume at the hospital-based ASC; most is done at the main hospital. How much volume should the group shift to the ASC once the joint-venture is operational in order to meet the one-third rule?

Scott Becker, JD, CPA: The group will have to not only generate one-third of its income from outpatient surgery, but its members will also have to perform one-third of the ASC cases at the ASC in which they are investors in order to meet the safe harbor.
