Risk vs. opportunity
Roughly 30 percent of ASC businesses fail, and many more never meet
their financial goals and projections. That is a scary number for
physicians to consider as they seek to develop their own ASCs, whether
independently or as a joint-venture with a hospital. My experience in
developing a multi-specialty ASC along with a group of colleagues and
in partnership with a local non-profit hospital gave me real insight

AMA Denied Request for Injunction Against United Healthcare; RICO Claim May Continue |

A class-action lawsuit against United Healthcare(UHC) has been denied its request for an injunction that would have stopped UHC's using certain practices to determine payment for out-of-network services. The suit, led by the American Medical Association and representing numerous employee health plan participants, can however continue with its claim that UHC violated the Racketeer Influenced and Corrupt Organization Act by understating its calculation of "usual, customary and reasonable" (UCR) charges when paying physicians or reimbursing patients for out-of-network medical services. |

Baucus, Grassley Agree to Drop Physician-Owned Hospitals as Offset From Upcoming Bill |

Physician Hospitals of America reports that it has "received information … that physician hospitals are no longer being used as an offset in the Mental Health Parity bill," says Molly Sandvig, JD, the organization's executive director. "The MHP bill was added to a pending 'tax extender' bill, which also covers the Alternative Minimum Tax issue. Although there was a rumor that physician hospitals may be added to the tax extender bill, that rumor has also been put to rest.

Hospital to Pay $89 Million to Settle Medicare, Medicaid Fraud Allegations |

Staten Island University Hospital (SIUH) has agreed to pay the federal government $74 million to settle claims that the hospital defrauded Medicare, Medicaid and the military's health insurance program, TRICARE, the U.S. Justice Department and the Eastern District of New York have announced. The hospital will also pay New York nearly $15 million representing damages sustained by the state's Medicaid program. |
