What ASC leaders need to know about Donald Trump's '2 for 1' executive order to cut regulations

President Donald Trump signed an executive order on Jan. 30 requiring lawmakers to eliminate two existing regulations in order to put one new regulation in place. 

The executive order could have nearly immediate consequences for healthcare, as Republican lawmakers are expected to repeal and replace — or at least modify — the ACA. President Trump announced earlier this week that he expects to release a replacement plan within weeks.

MGMA Senior Vice President of Government Affairs Anders Gilberg told Medscape the organization is in favor of the two-for-one legislation's philosophy of deregulation. The American Hospital Association is also in favor of reducing administrative burden and regulations.

There are several healthcare-related laws with regulations slated to roll out this year, including:

• 21st Century Cures Act
• Medicare Access and CHIP Reauthorization Act's Quality Payment Program
• FDA's new medical device review process

Recent employment rules could be eliminated as well, including the Fair Labor Standards Act's 2016 overtime rule, according to the National Law Review. OSHA's anti-retaliation/injury reporting rule and the Equal Employment Opportunity Commission's changes in data reporting could also be subject to the chopping block.

The executive order applies to regulations released from Jan. 20 to Sept. 30 and doesn't cover federal spending rules including Medicare spending, according to JDSupra Business Advisor.

Members of Congress are pushing forward with other plans to de-regulate healthcare, including lifting the moratorium on physician-owned hospitals and tackling the CMS bundled payments mandate.
