Federal judge allows House to challenge ACA — 4 observations

Federal judge Rosemary Collyer ruled that the House has the right to challenge the Affordable Care Act's use of subsidies to help low-income individuals afford insurance, according to USA Today.

Here are four observations:

1. Republicans claimed the spending provision needed congressional approval before granting the subsidies. Without the approval, Republicans state the funds should not have been spent.

2. The judge did not grant Republicans the right to sue the ACA over the unilateral delay in implementing the law's mandate requiring most large employers to offer health insurance or pay a fine.

3. Although the House did not object to the delay, House officials claim President Obama did not have the authority to impose the delay without congressional approval.

4. House Speaker John Boehner originally claimed he would sue President Obama over various other executive actions in areas such as immigration and international prisoner swap.
