Illinois Legislative Committee Maintains Stance to Prohibit New CON Rules

The Illinois legislative Joint Commission on Administrative Rules once again ruled to support its prohibition against certificate of need changes in the state that would be detrimental to ambulatory surgery centers, according to an Ambulatory Surgery Center Association of Illinois report.

The CON board proposed legislation would eliminate the "multispecialty" and "limited-specialty" ASC designations, requiring ASCs to seek new CON approval before adding a new surgical specialty. A meeting on Dec. 17 gave JCAR the opportunity to renew its support for prohibiting the new rule.

JCAR found the rules "will have an undue economic impact on entities to whom service approvals have already been issued" and "found that the adoption of this rulemaking would constitute a serious threat to the public interest," according to the report.

JCAR plans to bring stakeholders together early next year to discuss their differences and potential next steps.
